EACC 11 OF 2015 - Republic vs Irene Wanjiru Kamau and 4 others

Summary: The accused persons were charged with failing to observe procurement protocols in the direct procurement method for the purchase and supply of 16 motor vehicles belonging to the County Government of Machakos. Prosecution witnesses avered that the procurement process was above board. Thay also declared that there was value for money in the purchase of said vehicles. At the close of the prosecution's case, the prosecutor made an application to withdraw the case under Criminal Procedure Code 87(a) on grounds that they had received instructions from the DPP to the effect that when the case at hand was being investigated, the commission was not properly formed and therefore any investigations resultant of that were tainted with irregularities. The application was opposed by counsels for the accused and instead prayed for acquittal. Application disallowed. Court proceeded to give a no case to answer
