Prosecution witnesses avered that the procurement process was above board. Thay also declared that there was value for money in the purchase of said vehicles. At the close of the prosecution's case, the prosecutor made an application to withdraw the case under Criminal Procedure Code 87(a) on grounds that they had received instructions from the DPP to the effect that when the case at hand was being investigated, the commission was not properly formed and therefore any investigations resultant of that were tainted with irregularities.
