ACC 28 OF 2014 - Republic vs Christopher Kamau Njenga

Summary: The accused while in his duties on 18/10/2014 impunded a motorbike belonging to the complainant, who had at the time assigned the bike to a rider who he had employed to do mail delivery business within the CBD. It is alleged that when the complainant went to inquire on the bike at impound, he encountered the accused who solicited for Kes.15,000 for the bike to be released. The accused later inflated the amount to Kes.17,000, prompting the complainant to report the matter to EACC who facilitated recording to verify the complaint and prepared trap money to nab the accused. The complainant approached the accused and upon demand he handed over the trap money to the accused, at which point EACC officers arrested him. In reviewing the recording played in court, the court noted that the conduct of the accused was not one of an innocent mind, and that he in cohoots with others were intent on soliciting for a benefit from the complainant for their own benefit. As such, the accused was found guilty in count 3 and 4. Asregards count 5, the court observed that the recordings and witness testimony clearly showed that the accused received the money from the complainant, and proceeded to convict him on that count as well.
