ACC 14 OF 2011 - Republic vs Robert Maina Kinyua

Summary: The accused, an accounts assistant with the Ministry of Education, was assigned the administration of a sum of Kes. 4,569,300 meant for a training scheduled to be held at Shanzu Teachers Training College. The workshop was held, and the accused made an acount of his imprests as required. On examination of the imprests, by the Ministry, it was established that there were irregularities with the documents, prompting the involvement of the EACC. Investigations revealed that the accused had forged figures and impressions on certain documents. Workshop participants disowned figures and signatures indicated in Tranport Reimbursement Schedules as fakes. The accused also submitted fake Mash Bus Services bus receipts attached to his surrender vouchers, which Mash disowned. Attendants and facilitators testified that they had not received monies as indicated in 14 payment schedules filed by the accused, and neither had they appended their signatures, or their ID numbers, or any personal identification details on those schedules. In other cases, the accused allegedly inflated figures he had given to participants. He was araigned in court and convicted.
